The governing authority of and/or in any (and all) interpretation(s) and/or clarification(s) and/or definition(s) of/in/by/for the AUP (whole, or in part(s)) does exist solely with E10Host and not Customer.

§ 1 Offensive Content
Customer may not publish or transmit via E10Host’s service(s) any content(s)1 that E10Host reasonably suspects:
- Constitutes child pornography.
- Constitutes pornography.
- Is excessively violent, incites violence, threatens violence, and/or contains harassing content or hate speech or is otherwise disorderly or unharmonious to/of/in/for Human Right(s).
- Is unfair and/or deceptive under consumer trade and protection law(s) of any lawfully and/or legally recognized Sovereign and/or State and/or Intra-state and/or Interstate and/or National and/or Intra-national and/or International jurisdiction(s) (including, but not limited to) chain letters, pyramid schemes, and/or provisioned in/by/for/of fraud.
- Is defamatory and/or violates a person’s (living or non-living) and/or other entity’s (living or non-living) privacy.
- Creates and/or provides a risk to a person’s (living or non-living) and/or other entity’s (living or non-living) private and/or public safety and/or private and/or public health.
- Creates and/or provides a risk to any public safety and/or health.
- Compromises Sovereign and/or State and/or Intra-state and/or Interstate and/or National and/or Intra-national and/or International security, or interferes with investigation(s) by law enforcement.
- Improperly exposes trade secrets or other confidential or proprietary information of another person (living or non-living) and/or entity (living or non-living).
- Is created and/or intended and/or designed and/or fashioned in/by/of code(s) and/or script(s) and/or software(s) and/or hardware(s) to assist others in defeating technical copyright protection(s).
- Clearly infringes on, but not limited to, another person’s and/or entity’s registered and/or trade and/or service mark(s), patent(s), copyright(s), and/or other real and/or intellectual property right(s).
- Promotes illegal (if not, unlawful) drugs.
- Violates export control law(s) of any lawfully and/or legally recognized Sovereign and/or State and/or Intra-state and/or Interstate and/or National and/or Intra-national and/or International jurisdiction(s).
- Relates to illegal (if not, unlawful) gambling.
- Clearly or ambiguously promotes and/or provisions illegal (if not, unlawful) arms/weapons/firearms trafficking prohibited by any lawfully and/or legally recognized Sovereign and/or State and/or Intra-state and/or Interstate and/or National and/or Intra-national and/or International jurisdiction(s).
- Clearly or ambiguously promotes and/or provisions illegal (if not, unlawful) human trafficking prohibited by any lawfully and/or legally recognized Sovereign and/or State and/or Intra-state and/or Interstate and/or National and/or Intra-national and/or International jurisdiction(s).
- Is otherwise knowingly (or, unknowingly …Ignorance of the law is no excuse.) illegal (if not, unlawful) and/or solicits conduct that is unlawful and/or illegal under law(s) applicable to Customer or to E10Host.
- Is otherwise malicious, fraudulent, or may result in any form or manner of retaliation(s) and/or belligerence(s) and/or attack(s) against E10Host and/or Customer by offended viewers.
1 “Published and/or transmitted” via E10Host’s service(s) include(s): Web content(s), e-mail(s), bulletin board posting(s), chat(s), and/or any other type(s) of posting(s) and/or transmission(s) that relies on any Internet service(s) provided by E10Host (whole, or in part(s)).
§ 2 Abuse
Abuse in any form, manner, fashion, and/or degree by any form, manner, fashion, and/or degree is not acceptable use at/in/on/for/of/by/from/to Web site(s). (Additionally, see: Section 7(a) (Abuse) in the TOS)
Abuse, in any form(s) (including, but not limited to: variation(s), degree(s), and nature(s)), found placed (by or in any manner(s) by or for any reason(s)) on and/or about Web site(s) is publicly and/or privately consequentially serious.
Web site(s) has employed or otherwise incorporated programmed automation “abuse check” (commercial and/or private and/or entrepreneurial software(s)/script(s)/code(s)). Web site(s) provides additionally, “Human Active Review” in compliment (or, times separate) to the automated mentioned.
§ 3 Security
Customer must take reasonable and prudent security precaution(s). Customer must protect the confidentiality of Customers’ password(s), and Customer should, and ought to, change Customers’ password(s) periodically.
§ 4 Bulk Commercial E-Mail
Customer must obtain E10Host’s advance approval(s) for any bulk commercial e-mail(s). E10Host approval of bulk commercial e-mail(s) is dependant upon Customer ability demonstration, to E10Host’s reasonable satisfaction, the entirety (minimally) of the following:
- Customers’ intended recipients have given their consent to receive e-mail via some affirmative means, such as an opt-in procedure;
- Customers’ procedures for soliciting consent includes reasonable means to ensure that the person giving consent is the owner of the e-mail address for which the consent is given;
- Customer retain evidence of the recipient’s consent in a form that may be promptly produced on request, and Customer honor recipient’s and E10Host’s requests to produce consent evidence within 72 hours of receipt of the request.
- The body of the e-mail must describe how the e-mail address was obtained, for example, “You opted in to receive this e-mail promotion from our Web site or from one of our partner sites,” and information on how to request evidence of the consent, for example, “If you would like to learn more about how we received your e-mail address please contact us at abuse@**yourdomain.com**.
- The body of the e-mail must describe how the e-mail address was obtained (for example, “You opted in to receive this e-mail promotion from our Web site or from one of our partner sites”) and information on how to request evidence of the consent (for example, “If you would like to learn more about how we received your e-mail address please contact us at abuse@**yourdomain.com**).
- Customer have procedures in place that allow a recipient to easily revoke their consent (such as: “a link in the body of the e-mail”, or “instructions to reply with the word “Remove” in the subject line”). Revocations of consent are to be honored within 72 hours, and you notify recipients that their revocation of their consent will be honored in no more than 72 hours;
- Customer must post an abuse@**yourdomain.com** e-mail address on the first page of any Web site associated with the e-mail, Customer must register that address at abuse.net, and Customer must promptly respond to messages sent to that address;
- Customer must have a Privacy Policy posted for each domain associated with the mailing;
- Customer has the means to track anonymous complaints;
- Customer may not obscure the source of Customer’s e-mail in any manner. Customers’ e-mail must include the recipients e-mail address in the body of the message or in the “TO” line of the e-mail; and
- Customer shall include otherwise complete compliance with the CAN SPAM Act and other applicable law(s).
These policies apply to message(s) sent using Customers’ E10Host service(s), and/or to message(s) sent from any network(s) by Customer or any person(s) on Customers’ behalf that directly or indirectly refer(s) the recipient(s) to site(s) hosted via Customers’ E10Host service(s). In addition, Customer may not employ use of third party e-mail service(s) that does not practice similar and like-in-kind procedure(s) for all its’ customers.
E10Host may test and otherwise monitor Customers’ compliance with E10Host requirements, including (but, not limited to) requesting opt-in information from a random sample of your list at any time.
§ 5 Material Protected by Copyright
Customer may not publish, distribute, or otherwise copy in any manner any music, software, art, or other work protected by copyright law(s) unless Customer:
Has expressly authorization by the owner of the copyright for the work to copy the work in that manner, or
Is otherwise permitted, by established UNITED STATES copyright law(s), to copy the work in that manner.
E10Host will terminate the service(s) of repeat copyright infringer(s) and may, can, or will report to proper authorities.
§ 6 Site Rippers, Mass Downloader’s, and Offline Browsers
Customer(s) to/by/in E10Host may not, under any circumstances, employ the use of: site ripper(s), offline browser(s), site downloader(s), or automated software(s) to access or download anything from our web-site(s) or forum(s). (It is forbidden to “Save” entire pages and/or to willfully and knowingly download (or “otherwise gain access to” for any reason(s) known or unknown) graphic(s), preset(s), or other material(s) from E10Host and/or Customer site(s).)
Note: Indefinite banishment will be the resultant action of E10Host for anyone engaging employ(s) of these types of code(s), script(s), and/or software(s). Anyone indefinitely banned potentially can (if not, will) be banned indefinitely from all E10Host sister sites.
§ 7 Disclaimer
E10Host is under no warranty(ies) (expressed or implied), responsibility, duty and/or obligation, and does not by this AUP undertake a duty and/or obligation, to monitor or police Customer activity(ies) and disclaims any and all warranty(ies) (expressed or implied), responsibility(ies), duty(ies), and/or obligation(s) for any misuse(s) of the E10Host network(s).
E10Host may, at its sole discretion (by and through this AUP), undertake to monitor and/or police activity(ies) of Customer(s) in real-time. (Such activity(ies) being, at anytime – unannounced, for training, quality control, or other commercially reasonable and prudent reason(s) of/in/by/for viable commercialism purpose(s) being implemented manually or remotely scheduled (or, in spontaneity) for training, quality control, or other commercially reasonable and prudent reason(s) of/in/by/for viable commercialism purpose(s).) E10Host disclaims any and all warranty(ies) (expressed or implied), responsibility(ies), duty(ies), and/or obligation(s) to further provide notice to Customer(s) (beyond this mention) for any such monitoring(s) and/or policing(s) of Customer(s) in real-time manner-in-mention of/for/in E10Host network(s) (whole, or in part(s)).
